OK Express Easter Scooter Competition 2025 (“Promotional Competition”)

  1. 1. Promoters:
    The promoter is OK Franchise, a division of Shoprite Namibia (Pty) Limited, (hereinafter the “Promoter”).

  2. 2. Agreement to these Terms and Conditions:
    1. 2.1   By entering this Competition, all participants agree that they have read and understood these terms and conditions (“Terms and Conditions”) and further agree to be bound by these Terms and Conditions as interpreted by the Promotor, whose decision regarding any dispute will be final and binding.
    2. 2.2   The Promotor reserves the right at any time, without notice, to amend, modify or change these Terms and Conditions and any prizes, and to postpone, suspend or cancel this Competition and any prizes or any aspect thereof without notice at any time for any reason which the Promotors reasonably deem necessary and without any compensation whatsoever.
    3. 2.3   Neither the Promoter, its agents, service providers, suppliers, associated companies, nor any directors, officers or employees of such, shall be liable for any loss or damage, whether direct, indirect, consequential or otherwise arising from any cause whatsoever, which may be suffered by the participant.
    4. 2.4   All personal information of the participants will be processed by the Promoter in accordance with the Shoprite Group Data Privacy Statement found at: https://www.shopriteholdings.co.za/content/dam/shp/docs/shp-data-privacy.pdf

  3. 3. Eligibility:
    1. 3.1  This promotional competition (“Competition”) is only open to permanent residents and citizens in Namibia, of the age of 18 (eighteen) years and older, living in Namibia and in possession of a valid form of identification (Identity Document or Passport), a lawful residency permit or proof of current address not older than 3 (three) months.
    2. 3.2   All participants must be natural persons. Legal entities cannot participate in this Competition and no prize/s will be awarded to any legal entities.
    3. 3.3   Any director, member, partner, employee, agent or consultant of the Promoter, the marketing service providers, suppliers, distributors or any person who directly or indirectly controls or is controlled by these entities, including their spouses, life partners, business partners or immediate family members may not enter or participate in the Competition and will be disqualified from receiving a prize.

  4. 4. Competition Period:
    1. 4.1   This Competition will start on 3 March 2025 (“start date”) and end on 4 May 2025 (“closing date”), both days inclusive.
    2. 4.2   The period from the Competition start date to closing date is referred to as the (“Competition Period”).
    3. 4.3   No entries outside of the Competition period will be accepted.

  5. 5. Mechanics:
    To enter the Competition, a participant must adhere to the following:
    1. 5.1   Purchase any 2 (Two) of the participating products (“Annexure A - Participating product”) listed below from any OK Express store (“Annexure B- Participating Stores”) in Namibia during the Competition Period. A list of the participating products will also be available on www.okfoods.co.za
    2. 5.2   Purchase of the participating products from the participating stores must be made during the Competition Period. Any purchases made before or after the Competition Period do not qualify.
    3. 5.3   Participants will automatically be entered into the competition when they swipe their OK Count On! card when purchasing the participating products during the Competition Period. An automated SMS will only be sent once to confirm the first automatic entry. An SMS will not be sent again throughout the Competition Period when entering.
    4. 5.4   Participants may also enter via SMS using their unique token number found on their till slip to 2222. Alternatively, enter via USSD by dialling the following number: *142*943*{unique token} during the Competition Period. An automated SMS will be sent to confirm the entry, standard SMS network rates do apply.
    5. 5.5   Participants may enter multiple times during the entire competition period subject to each entry being linked to a new separate valid purchase of any participating product.
    6. 5.6   Participants must keep their till slip as proof of purchase.
    7. 5.7   Each entry will be considered final by the Promotors. Incomplete, inaccurate, unclear, erroneous, ineligible or incomprehensible entries will be deemed invalid and thus disqualified.
    8. 5.8   Neither the Promoter nor its agents or suppliers will be liable for the failure of any technical element relating to this Competition that may result in an entry not being successfully submitted, or for entries that are lost, damaged or delayed.
    9. 5.9   The Promoter reserves the right to disqualify any potential winner at its discretion, should they:
      • 5.9.1   Have won a prize in a competition conducted by the Promoter or its affiliated companies during the last three (3) months before the winners of this Competition is drawn;
      • 5.9.2   Act in a manner contrary to the spirit of the Competition, or if fraud or cheating is suspected, including but not limited to the manipulation of code or falsification of data.
      • 5.9.3   Fail to provide the required supporting documentation upon request by the promote within 5 (Five) days.
      • 5.9.4   Submit verification documentation that does not correspond to the data associated with their OK Count On! Profile.
    10. 5.10   No applications from agents, third parties, organized groups or applications automatically generated by computer will be accepted. No incomplete or corrupted entries will be accepted. Entries will only be accepted if they comply with all entry instructions.

  6. 6. Prize/s:
    1. 6.1   1 (One) potential winner stands a chance to win a Suzuki Avenis Scooter with a total value of N$ R32 350 (Thirty-Two Thousand Three Hundred and Fifty Namibian Dollars).
    2. 6.2   Prizes are not transferable and may not be deferred or exchanged for cash, credit or otherwise.
    3. 6.3   In the event that the prize is not available despite the Promoter’s reasonable endeavors to procure the prize, the Promoter reserves the right to substitute prizes of equal value.
    4. 6.4   Prize visuals on any competition and/or promotional materials are for illustrative purposes only;
    5. 6.5   Participants understand and agree that they may win a prize, but there is no guarantee that they will win a prize.
    6. 6.6   Each winner will only be entitled to 1 (one) prize.
    7. 6.7   The Promotors shall not award a Prize to a winner if it is unlawful to supply such Prize to the winner. In such instances, the winner shall immediately forfeit the Prize and be disqualified. 6.8   The winners will not be entitled to payment, credit or otherwise in the event that they do not receive or utilise the prize to the fullest extent possible. Any item or value unused will be deemed waived by the winners.
    8. 6.9   The details of the prize will be entirely at the Promoter’s discretion – the winners will not be entitled to choose their prize.
    9. 6.10   Prize specifications are subject to change, pending stock availability from the manufacturer.
    10. 6.11   Once the winner has received the Prize, the Promoters shall not be liable and shall not take responsibility for any product malfunction or defect or manufacturing faults or defects, or damage or loss of the Prize.
    11. 6.12   Ownership of and risk in and benefit attached to the Prize will be passed on to the winner immediately.
    12. 6.13   The Prize does not include servicing, any safety gear (helmet), maintenance of the Scooter, petrol or any additional enhancements for the scooter after the Prize has been awarded.
    13. 6.14   The winners confirm that neither the Promoter nor the selling Dealership is responsible to obtain trade in valuations or negotiate such on their behalf. Registration and licensing of the scooter is the sole responsibility of the winner.
    14. 6.15   The Promoters and third-party service providers do not cover insurance for the Prize and will be the sole responsibility of the winner.

  7. 7. Selection of the Winner:
    1. 7.1   A random draw will be conducted on 5 May 2025, by the Promoter’s independent representative to select a total of 1 (One) potential winner.
    2. 7.2   The potential winner will be required to undergo a verification process before they will be declared the official winner of the competition.
    3. 7.3   The potential winners will be notified within 2 (two) working days after their names have been drawn.
    4. 7.4   Should there be no successful contact with the selected potential winner within a 48-hour period, the Promoter reserves the right to proceed and select a new backup potential winner.
    5. 7.5   Winner will be required to sign and return to the Promoters, within 5 (five) working days of the date of the confirmation by the Promoter, a Prize Acknowledgement and Indemnity form (“Declaration”), valid form of identification (Namibian Identity Document or Passport), a lawful residency permit or proof of current address, not older than 3 (three) months and a copy of their Count On! Card, only applicable to Loyalty Card Holders, to claim their Prize. A copy of their till slip will be required for SMS or USSD entries.
    6. 7.6   The Promoter’s decision in this Competition will be final and no correspondence will be entered into.

  8. 8. Delivery of Prizes:
    1. 8.1   Delivery shall occur within 3 (Three) weeks following the successful verification and declaration of the winner.
    2. 8.2   Any delay in delivery shall be communicated to the winner to facilitate appropriate arrangements.
    3. 8.3   Any expenses incurred by the winner, other than the items listed in the prize will be from the winner's own account.

  9. 9. Promotional Material and Marketing Activities:
    1. 9.1   Winners waive their moral rights and grant the Promoter exclusive, unlimited, perpetual and free of charge copyright and usage (in any territory where these entities trade), in all media forms of all material, text and intellectual property created and/or published/posted by the participants in the submission of their competition entry. The Promoter will be entitled to use and edit the intellectual property in any manner and in its sole discretion, for an indefinite period of time and in any territory where it trades. Participants will not during or after the closing date of the Competition dispute or question such copyright and usage.
    2. 9.2   The Promoters may require the Winner to be identified, photographed, and published in printed media, social media, social digital media channels, or to appear on radio and/or television, without any payment or other remuneration when accepting the Prize. The Winner will be given the opportunity to decline to the publication of their image and to participate in the Promoters’ marketing materials in so far as it relates to the Competition.
    3. 9.3   Winners waive any right to demand royalties, usage fees or any other form of compensation or payment for the use of intellectual property in the participant’s entry.
    4. 9.4   This Competition is in no way sponsored, endorsed or administered by, or associated with any social media channel and the participants acknowledge that they are providing information to the Promoter and its agents only and not to any social media channel.

  10. 10. Data Privacy:
